Trademarks

A trademark is a sign capable of distinguishing the goods or services from others. Its owner may be a natural or legal person.

The trademark world is wide, including words, drawings, emblems, monograms, packaging, combinations of letters and numbers, slogans, reliefs, etc.

A trademark registration is a title issued by the TMO, which confers to its owner an exclusive right and the faculty of protecting it from misappropriations or undue use.

Trademark registration is prima facie evidence of its validity, and therefore the use performed by the trademark owner or authorized parties is deemed legitimate.

Author's rights

The creator of an original work capable of being reproduced may enjoy of the exclusive right for a limited period.

The number of works protectable by author´s rights includes paintings, literary works and musical compositions, source, and object computer programs, compilations of data or other materials, dramatic-musical works, cinematographic, sculpture and architecture, models and works of art or science-applied to trade or industry, printed matter, plans and maps, photographs, recordings, and phonograms, among others.

Authors’ rights cover the moral rights of the authors and the economic rights of the work.

The following moral rights are recognized by law:

  1. Paternity – the right to claim authorship of a work according to the author’s choice (e.g., pseudonym, author’s name, anonymously).
  2. Integrity – the right to oppose any unauthorized modification, distortion, mutilation, or any other act that undermines the integrity of the work.
  3. The right to Publish the author’s work.

Economic rights, include the faculties to dispose of the work; assign and exploit it (i.e., to reproduce, publish, perform, publicly exhibit, translate, adapt, or authorize the translation of the work).

Domain names

Domain names are names used to identify an internet address.

They are formed by the rules and procedures of the Domain Name System (DNS), which is a global addressing system where domain names are located and translated into Internet Protocol (IP) addresses, and vice versa.

Any physical or legal entity can apply for the registration of a domain name (Registrant).

We may find different categories of domain names such as:

  1. GTLD (generic top-level domain):.gov (government agencies), .edu (educational institutions), .org (non-profit organizations), .mil (military), .com (commercial business), .net (network organizations), .aero (entire aviation community), .biz (business purposes), .coop (cooperatives), .info (information), .museum (museums), .name (personal names, .pro (professionals); among others.
  2. ccTLD (country code top-level domain: .ar Argentina, .br Brazil, mx Mexico). Same are administered independently by nationally designated registration authorities.

 

Every domain registration is governed by the rule “first come, first served…”, i.e., priority is given to the one who applies for the domain registration first.

Nevertheless, under certain circumstances, it is possible to recover a domain name. The dispute resolution policies will vary depending on the type of domain and factual background of the specific matter.

Industrial designs

An industrial design protects the ornamental or aesthetic aspect of an industrial product.

A design may consist of three-dimensional features, such as three-dimensional shapes, or two-dimensional features, such as patterns, combinations of lines or colours.

Which requirements are needed to obtain industrial design protection?

Industrial designs must meet the following requirements:

  1. Novelty: No identical designs must have been published or used in Argentina or abroad before the filing date of the new model.
  2. Industrial character: Industrial design must be created for being used or exploited for industrial purposes.
